A Little Bit About The BP Settlement For Individuals

First there was the Gulf Coast Claims Facility (GCCF) that was only helping people out if they where ready to take a Quick Pay, $5,00o for individuals and $25,000 for business. If you where not ready to take a Quick Pay very few people got help in the GCCF. Now the BP settlement has been agreed on in principal and it has no cap on how much the BP settlement will pay out. This marks a new beginning for many people stranded in the GCCF. The BP Settlement is court supervised and its supposed to be transparent. Also in the new individual BP settlement many people working in the seafood industry or within 1/2 mile from the beach will not have to prove anymore that the BP oil spill did the damage to their wages, commission, job or what ever was lost in the wake of the BP oil spill. Anybody that has been denied by the GCCF should get an attorney and try the individual BP settlement process as they might get approved under this new BP settlement.

Who Can Use The BP Settlement Process

Anybody that can show a loss in income cause by the BP oil spill, the lack of tourist because of the BP oil spill should apply. The loss of income could be because of a job loss after April 20 2010, or fewer hours after April 20 2010. Here is a short list of everybody that can apply.

The point that is still important in the individual BP settlement process is the documentation that you can show to prove the loss of income. Its very important as the attorney would need this information before he could put your claim into the individual BP settlement process.

Individual BP Settlement Document Requirements

Now since the BP settlement was reached some information has come out with the requirements to participate in the BP settlement. This section will be updated as more information becomes available. What we know now is that the documentation requirement will be much less in the BP settlement for individuals. First off it will be base on 3 month documentation for the worst 3 month of 2010, where the job and earning situation for you was just terrible. Then you will take the same 3 month for 2009 and compare them to. It has also been suggested in the BP settlement that you would be able to take 3 month from 2007 or 2008 to compare to the 2010 numbers.

Now this has to be documented with W2′s or tax returns and you have to get some employment verification or maybe an occupational license. What ever you have that will prove you job and salary will be good for the attorneys to bring to the BP settlement.

Also you have to have a negative 2010, or you have to prove that you had more hours or 2 jobs in 2010 after the BP oil spill to make the same money as you did in 2007-2008-2009. For many people this should be a lot easier than the process the GCCF was trying to get you to go though to prove your case. The other thing that will make it a lot easier this time is the attorney that will handle your BP claims for you.

Individual BP Settlement Class Zones

This is another part of the new individual BP settlement process that will make it a lot easier for people who work on or near the beach to file an individual BP settlement claim with an attorney. In the new BP settlement you don’t have to prove that the BP oil spill was the reason for your losses its assumed it was. So if you live in Zone A  you will just have to prove you loss of income and will be paid a multiplier on that loss.

Now if you work in a tourist related industry or are working in the seafood industry, processing, harvesting or serving you should not have to prove under the new BP settlement that the oil spill was the cause of your losses it is just assumed and all you have to prove are your losses.

Calculation Models For Individual BP Settlement Claims

This part is has not been shown yet to anybody what kind of multiplier you should expect on your losses. An example of how it was at the GCCF you would get 1.8 times your proven 2010 losses. Expect the multiplier to be higher in the BP settlement maybe up to 2.5 maybe even higher for some industries.

When the multipliers are official and the BP settlement has been approved we will edit this section and have the latest information available before you decided to Opt in and Opt out of the proposed BP settlement.

Part of the transparency in the new BP settlement should be an easy way to calculate what the BP settlement offer would be before you Opt. in or out of the settlement.
